Suntracker Pontoon Policies

Rental Rules & Regulations: 

• Operator must be at least 21 years of age and possess a valid drivers license
• At NO time shall the operator of the watercraft be under the influence of drugs or alcohol 
• Renter assumes full responsibility for all damages to watercraft while under contract 
• No skiing, tubing or towing of persons or objects are permitted at any time 
• No barbeque grills, pets or beaching of watercraft will be permitted 
• Children 12 and under are required by State law to wear life jackets at all times 
• Watercraft returned late will be subject to a late fee of $50 per half hour 
• Rental boats returned dirty will be subject to a min. $50 clean up fee 
• Boat rental prices do not include sales tax, fuel or supplies, and are subject to change 
• Changes to existing reservations boat type, rental date or time must be made at least 48 hrs. before the reservation date and cannot be processed online. Please call the location in which the reservation was made to make these arrangements.
• Any cancellation made more than 48 hrs. before the reservation date will be charged a $30 processing fee.
• Any cancellation made less than 48 hrs. before the reservation date will result in a forfeit of the half reservation amount. Any cancellations made within 24 hours will result in a forfeit of the full reservation amount. 
• If the following conditions exist on the lake; heavy rain lasting more than 45 minutes; lightening; tornado warnings; high wind advisories or any condition that Clinton Marina considers unsafe boating conditions, then the reservation fees will be credited. Weather credits or rain checks can only be given in person on the day of the rental and are based on actual weather conditions on the lake at the time of the rental not future weather forecasts.

In consideration of the rental fees paid, Clinton Marina rents the above described boat to the undersigned, as Lessee, on the following conditions and terms:

(1) Lessee certifies that she or he is at least 21 years of age, holds a valid drivers license, and agrees that the Lessee will not operate the watercraft while under the influence of alcohol or narcotics, and will permit no one else to operate the watercraft;
(2) Lessee further acknowledges that he or she has been instructed in and fully understands the safe operation of the watercraft and agrees to observe all safety precautions and applicable laws and regulations: a. Lessee agrees to stay in deep water at least 100 yards from shore, agrees not to stand up or permit anyone to stand up or ride on boat gunwales while the boat is in motion, and not to ride on the bow or stern of the boat, b. Lessee acknowledges that not following safety rules could be dangerous to Lessee, passengers, and others;
(3) Lessee agrees the watercraft rented is due back to the Marina at scheduled time or not later than 5:00 pm or by 4:00 pm on Sunday, and to pay for all rental charges and all fuel used;
(4) Lessee agrees to return the boat in the same condition as when leased, normal wear and tear expected, and to pay an additional minimum cleaning fee of $50.00 if the watercraft is returned unreasonably dirty. Lessee acknowledges that he or she is responsible for any damage to the watercraft and other equipment in possession, including the prop, hull, anchor, life preservers, windshield, engines, and the property of others that may be damaged while the boat is in use and any costs to Clinton Marina associated with the loss of rental income due to equipment downtime. Lessee acknowledges that there are certain natural hazards in connection with boating and the undersigned waives all claims against the Lessor for damages of injuries incurred by Lessee, and agrees in to indemnify Lessor against all claims made by passengers or others injured of damaged in connection with the operation or the use of the watercraft;
(5) Lessee agrees that there are no refunds due for early return of the watercraft due to weather; (6) Lessee agrees to operate the watercraft not closer than 100 yards from any vessel or shoreline (other than idle speed), not to beach the watercraft, to operate the watercraft only at idle speed inside no wake areas, and not to tow another watercraft. No skiing, tubing or towing of persons or objects is permitted at any time;
(7) Lessee agrees that unpaid items, including agreed upon costs of boat rental, fuel, or reimbursement for any damage done to watercraft shall be charged to Lessee's credit card; (8) Lessee agrees that any breach of terms will result in revocation of rental property and loss of any fees paid; (9) Lessee agrees no pets or bar-b-que grills are permitted on the watercraft.

ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS AND RELEASE OF LIABILITYAND INDEMNITY

WARNING: There is significant risk in any sport or outdoor activity, including the use of boats, jet skis, or other watercraft. Wind, wave action and other boat wakes can make it difficult to maneuver watercraft. REPRESENTATION, ACKNOWLEDGMENT AND ASSUMPTION OF RISKS:
By accepting the watercraft pursuant to this Boat Rental Agreement and by signing on page 2, you (i) represent that you are trained in the operation of the watercraft and do not have any questions regarding its safe operation; (ii) acknowledge that you understand that operating a watercraft is subject to numerous risks, including risk of loss or damage to equipment, illness and personal injury, including but not limited to permanent physical injury or death to you and others (hereinafter the "Risks"); (iii) acknowledge that the Risks may be caused by your own actions or inactions or the action or inaction of others and assume all such Risks; and (iv) acknowledge that the Risks may include social and economic losses either not known to be or not readily foreseeable at this time; and (v) FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS AND DAMAGES INCURRED AS A RESULT OF USING THE WATERCRAFT PURSUANT TO THIS BOAT RENTAL AGREEMENT.

NOTICE of possible additional charges after boat has been returned:
Late Fee $ 25.00 per 15 minutes
Prop Damage Repair $ 150.00
Prop Damage Replacement $ 250.00
Interior/Exterior Cleanup due to unreasonably dirty $ 50.00 minimum
Interior/Exterior damages to the following but not limited to: Cost plus 20%
carpet, seats, radio, bimini top, pontoons, depth finder.
